TEMPORARY PROTECTIVE STATUS (TPS) EXTENDED FOR HAITIAN NATIONALS UNTIL JANUARY 2021
EMBASSY OF THE REPUBLIC OF HAITI IN WASHINGTON, D.C. — Due to pending litigation, on Friday, October 31, 2019, the Department of Homeland Security (DHS) has extended Temporary Protected Status (TPS) for recipients from the Republic of Haiti and other nations until January 4, 2021.
However, the Embassy urges all stakeholders and recipients to continue their advocacy efforts in the United States Congress. In particular, in the United States Senate where the Dream and Promise Act of 2019 is under consideration. If passed, over fifty-thousand Haitian nationals who are Temporary Protective Status(TPS) recipients, millions of Deferred Actions for Childhood Arrival (DACA) recipients, and Deferred Enforced Departure (DED) recipients may immediately apply for green card and ultimately, citizenship. The petitioner must have been in the country for at least three years, had status as of September 2016, and successfully pass a background check. In addition, within five (5) years of obtaining a green card, all three groups could apply for citizenship.
Immigrants who have been convicted of crimes punishable by more than one (1) year in prison, or have been convicted of three or more offenses that carry sentences of more than 90 days in jail, would not be eligible.

STATUT DE PROTECTION TEMPORAIRE (TPS) PROLONGÉ POUR LES CITOYENS HAITIENS JUSQU’A JANVIER 2021
***** AMBASSADE DE LA RÉPUBLIQUE D’HAITI A WASHINGTON, D.C. — A cause d’un litige pendant, le vendredi 31 octobre 2019, le Département de la Sécurité Intérieure (Homeland Security – DHS) a prolongé le Statut de Protection Temporaire (TPS) en faveur des détenteurs de la République d’Haïti et d’autres nations jusqu’au 4 janvier 2021.
Cependant, l’Ambassade exhorte toutes les instances impliquées dans la lutte pour la prolongation ainsi que les détenteurs du statut de continuer leurs efforts auprès du Congrès des Etats-Unis d’Amérique, en particulier, auprès du Sénat où le Dream and Promise Act de 2019 est à l’étude. Si la Loi est approuvée, plus de cinquante mille ressortissants Haïtiens détenteurs du Statut de Protecion Temporaire (TPS), des millions de bénéficiaires du Deferred Actions for Childhood Arrival (DACA) et du Deferred Enforced Departure (DED), pourront immédiatement entamer la procédure d’obtention de la résidence permanente et ensuite la citoyenneté américaine. Le requérant doit avoir été dans le pays depuis au moins trois ans, avoir eu le statut (TPS) depuis septembre 2016, et avoir passé avec succès la vérification de son dossier criminel et autres antécédents (background check). De plus, après cinq (5) ans de résidence permanente (carte verte), les trois groupes pourront solliciter la citoyenneté américaine.
Les immigrants qui auront été condamnés pour crimes passibles de plus d’un (1) an de prison, ou pour au moins trois offenses entrainant des sentences de plus de 90 jours d’incarcération, ne seront pas éligibles.
